A Practice Note addressing the cause of action and related remedies available under Section 502(a)(3) of the Employee Retirement Income Security Act of 1974 (ERISA) for violations of employee benefit plan terms and ERISA. ERISA Section 502(a)(3) permits plan participants, beneficiaries, or fiduciaries to sue to enjoin a practice that violates ERISA or a plan's terms. ERISA Section 502(a)(3) also permits participants, beneficiaries, or fiduciaries to obtain "other appropriate equitable relief" to redress violations of ERISA or a plan, or to enforce ERISA or a plan's terms. The federal courts continue to interpret the scope of remedies under ERISA Section 502(a)(3) in litigated employee benefits disputes.
