A Practice Note explaining the key issues counsel should consider before applying for a preliminary or special injunction in a civil case in a Pennsylvania court of common pleas. Specifically, this Note outlines the types of preliminary injunctive relief available in Pennsylvania, explains the costs and issues associated with requesting a preliminary injunction, and addresses additional issues plaintiffs face when seeking ex parte relief (that is, without notice to the opposing party). This Note also addresses the remedies a plaintiff may pursue if a defendant does not abide by the terms of an injunction issued by the court and the consequences for wrongfully enjoining a defendant.
