This note explores how nuptial agreements are likely to evolve in the future by considering the changes that may be introduced by legislation in due course. The note focuses on the recommendations set out by the Law Commission in its final report on the Matrimonial Property, Needs and Agreements project published on 27 February 2014 (Law Com No 343). The practical implications of the recommendations, including the factors practitioners should consider when drafting nuptial agreements in the light of the recommendations, are discussed.
