This Legal Update reports on significant changes to the local and federal rules and procedures for all US federal district and appellate courts between May 1 and May 7, 2013. It also reports on changes to the individual practice rules for judges in select district courts during this time period.

Administrative Fee

Effective May 1, 2013, all federal district courts began charging a $50.00 administrative fee for filing a civil action, suit or proceeding in a district court, in addition to the $350.00 filing fee. A sample of this announcement can be accessed here.

Federal Circuit

Court of Federal Claims

The US Court of Federal Claims has its updated Fee Schedule, effective May 1, to reflect an increase in:
  • The attorney admission fee to $276.00.
  • The cost of a records search conducted by the clerk, to $30.00 per name searched.

District of Columbia Circuit

District of the District of Columbia

The US District Court for the District of Columbia has updated its Supplement to the Local Rules: Clerk's Office General Information and Filing Procedures, reflecting changes in the types of documents which cannot be electronically filed. First Circuit

First Circuit Court of Appeals

The US Court of Appeals for the First Circuit has released a new Rulebook, containing local rules of appellate practice in the circuit, which reflects amendments made through March 25, 2013. A copy of the old Rulebook is available here.

District of Vermont

The US District Court for the District of Vermont has its updated Fee Schedule, effective May 1, to include a pro hac vice fee of $150.00.

Second Circuit

District of Connecticut

The US District Court for the District of Connecticut has added the following forms:

Eastern District of New York

The US District Court for the Eastern District of New York released a new Miscellaneous Fee Schedule, effective May 1, which reflects an increase in the attorney admissions fee to $176.00.

Third Circuit

Third Circuit Court of Appeals

The Third Circuit Court of appeals has issued an order reducing the number of copies of appellate briefs parties are required to file. Effective May 1, parties are only required to file seven copies of each brief (one original and six copies).

District of New Jersey

Fifth Circuit

Northern District of Texas

The US District Court for the Northern District of Texas has updated its Fee Schedule, effective May 1, to apply the $50.00 administrative fee to:
  • Applications for Writ of Garnishment.
  • Complaints in Interpleader.
  • Motions to Quash IRS Subpoena or Application to Enjoin under 12 U.S.C. § 3410 (Customer Challenge cases).
  • Motions to Quash Administrative Summons.
  • Notices of Removal.

Southern District of Texas

Magistrate Ronald G. Morgan has updated his Civil and Criminal Procedures. A copy of the judge's old order is available here.

Western District of Michigan

The US District Court for the Western District of Michigan has updated its Local Rules of Civil Practice and Procedure and its Local Rules of Criminal Practice and Procedure. A copy of the old Civil Procedures is available here.

Northern District of Illinois

Magistrate Jeffrey T. Gilbert has updated his Standing Order for Settlement Conference. A copy of the judge's old order is available here.

Northern District of Indiana

The US District Court for the Northern District of Indiana issued an announcement that, effective July 1, 2013, the court will no longer accept cash when making a transaction over the counter.

Eighth Circuit

District of Nebraska

The US District Court for the District of Nebraska has added a resource, Attorney's Guide to Hyperlinking in the Federal Courts, and has issued a general order with regard to its pro se docket.

Ninth Circuit

Central District of California

The US District Court for the Central District of California has announced that new local rules will take effect on June 1, 2013, and updated its Notice of Interested Parties form.

Northern District of California

Magistrate Judge Charles R. Breyer has amended his Orders Setting Case Management Conference. A copy of the judge's old order is available here.

Southern District of California

The US District Court for the Southern District of California has updated its General Filing Procedures and Electronic Case Filing CM/ECF User's Manual. A link to the old User's Manual is available here.

District of Hawaii

The US District Court for the District of Hawaii has updated its Local Rules, to clarify how time is computed. A copy of the old local rules is available here.

District of Oregon

Tenth Circuit

Western District of Oklahoma

The US District Court for the Western District of Oklahoma announced that new Local Civil and Criminal Rules went into effect on May 1. The court has published a redline draft of the revisions.

Eleventh Circuit

Middle District of Florida

The US District Court for the Middle District of Florida has updated its Fee Schedule, effective May 1, to include:
  • A writ of garnishment fee of $100.00.
  • A fee for the handling of registry funds.

Middle District of Georgia

The US District Court for the Middle District of Georgia has updated its Fee Schedule, effective May 1, to reflect an increase in the fee for the exemplification of documents to $21.00.

Northern District of Georgia

The US District Court for the Northern District of Georgia has updated its Fee Schedule, effective May 1, to reflect an increase in the fee for a writ of mandamus to $400.00.
