The Occupational Safety and Health Administration (OSHA) issued final regulations on July 9, 2012 on the whistleblower provisions of the Consumer Product Safety Improvement Act of 2008, establishing the final procedures and time frames for handling retaliation complains under the Act.
On July 9, 2012, OSHA issued final regulations on the whistleblower provisions of the Consumer Product Safety Improvement Act of 2008 (CPSIA), which protect employees against retaliation by a manufacturer, private labeler, distributor or retailer for reporting violations of any act enforced by the Consumer Product Safety Commission to their employer, the federal government or a state attorney general.
Effective July 10, 2012, these regulations establish final procedures and time frames for handling retaliation complaints under CPSIA, including procedures and time frames for:
  • Employee complaints to OSHA.
  • OSHA investigations.
  • Appeals of OSHA determinations to an administrative law judge (ALJ).
  • ALJ hearings.
  • Review of ALJ decisions on behalf of the Secretary of Labor.
  • Judicial review of the Secretary of Labor's final decisions.
