The California Legislature passed SB 358 to improve California's equal pay provisions by amending Labor Code § 1197.5 to make it easier for employees to prove disparate pay claims and increase the burden on employers seeking to justify pay differentials. The new law also increases the time period for which an employer has to retain employee records and creates additional protections for employees who disclose their wages. SB 358 goes into effect on January 1, 2016.
