Texas Federal Judge Declares US CDC Residential Eviction Moratorium Unconstitutional | Practical Law
On February 25, 2021, a Texas federal judge ruled in Terkel v. Ctrs. for Disease Control and Prevention that the temporary national moratorium on residential evictions ordered by the Centers for Disease Control and Prevention (CDC) is unconstitutional. The moratorium, currently set to expire March 31, 2021, was first announced in September 2020 for tenants suffering financial hardships caused by the 2019 novel coronavirus disease (COVID-19) global pandemic.
