This Standard Document is an agreed-to order that directs the discovery of electronically stored information (ESI) in federal civil litigation. Counsel may use the e-discovery order to guide the negotiation of detailed standards for the preservation, collection, processing, search, review, and production of ESI. Counsel who negotiate these standards early can make informed, efficient decisions regarding e-discovery with a much lower risk of those decisions becoming the focus of long, costly discovery disputes or the basis for sanctions.
