At Practical Law, we are constantly expanding and updating our Health and Welfare Plan resources to reflect the latest developments in employee benefits law. The following list reflects some of the most important Health and Welfare Plan resources we published or substantially revised during Q4 2022:
Cafeteria Plans. We updated this resource to address developments that include final IRS regulations that changed the eligibility rules for obtaining premium tax credits for ACA health exchange coverage (known as the "family glitch" issue).
COVID-19 Compliance for Health and Welfare Plans. This resource is substantially updated to reflect, among other developments, HHS's renewal of its declaration (in October 2022) of a nationwide public health emergency due to COVID-19, the disease that results from SARS-CoV-2 and its variants.
ERISA Litigation: Preemption of State Laws: Complete Preemption. This newly published resource addresses how ERISA completely preempts certain state-law claims that would otherwise duplicate, supplement, or supplant ERISA's civil enforcement provisions.
ERISA Litigation: Preemption of State Laws (D to N). This newly published resource addresses how ERISA preemption applies to numerous state laws that govern employee benefit plans (or that would otherwise govern the plans, but for preemption). Companion resources address the framework of ERISA's preemption rule and analyze how the courts have applied ERISA's preemption provisions to additional state laws. 2022 Year-in-Review Webinar. In December 2022, four Practical Law senior editors presented a 2022 year-in-review webinar that addressed topics including the effect of the Supreme Court's Dobbs ruling on employer-sponsored health plans. The year-in-review webinar also addressed new laws in labor and employment, SEC rulemaking, and the crypto winter.
