Unit trust deed: registrable | Practical Law

A trust deed creating a unit trust that can be used where the unit trust will be a managed investment scheme that is required to be registered under the Corporations Act 2001 (Cth) (CA 2001) (a registered scheme). Where a unit trust meets the definition of a managed investment scheme under the CA 2001 and is required to be registered, the unit trust deed (also referred to as the constitution) needs to be in a form that meets the requirements of the CA 2001 and that is acceptable to the Australian Securities and Investments Commission.
