Advertising Practice
With rapid technological development and groundbreaking new media, reaching prospective purchasers through advertising and promotions has become increasingly complex. Kilpatrick Townsend’s Advertising and Marketing team advises clients in areas where new distribution and data platforms push the boundaries of technology, privacy, copyright, and content. This includes social media engagement, data collection and licensing, behavioral and mobile advertising, user generated/third party content use, online gaming, promotions, the rights of privacy and publicity, developing privacy policies, website terms of use, data security and data breach notification policies.
We routinely counsel on issues such as advertising compliance and claim substantiation, and have litigated numerous false advertising and unfair competition cases under section 43(a) of the Lanham Act and corresponding state laws. We also have extensive experience representing advertisers and marketers in regulatory investigations before government agencies (e.g. FTC), in competitor challenges through the self-regulatory process (e.g. NAD, CARU), and in responding to government inquiries and consumer complaints.
We also regularly draft and negotiate advertising industry contracts such as agency-client deals, brand licensing, co-promotion, celebrity talent, endorsement, influencer, and sponsorship agreements, as well as technology contracts including traditional licensing, data sharing, software development, cloud computing, hosting agreements, and website development agreements.
Another significant part of the practice is advising clients on the structure of and reviewing advertising and marketing campaigns, and drafting terms and conditions for all forms of marketing and promotion initiatives, including sweepstakes, online, mobile, and app games, skill contests, social media, fantasy sports, direct mail, telemarketing, and charitable marketing and co-venture programs.
Insurance Practice
Kilpatrick Townsend’s Insurance Recovery team is nationally and internationally recognized for its experience in the preservation and recovery of insurance assets for policyholders. The team’s lawyers are among the most experienced in the world in the litigation and trial of insurance coverage cases, and also account for an impressive body of scholarship, having published extensively in law reviews, industry magazines, and trade association publications. Collectively, the team has recovered billions of dollars in insurance benefits for their clients. Through their multinational practice, our attorneys have recovered insurance benefits for losses suffered and policies issued in the United States, Australia, Canada, Dominican Republic, France, Germany, India, Mexico, Norway, Republic of Panama, Portugal, Puerto Rico, Switzerland, United Kingdom, Venezuela, and off the Malaysian coast.
