A Checklist of compliance considerations involving nonquantitative treatment limitations (NQTLs) under the Mental Health Parity and Addiction Equity Act of 2008 (MHPAEA). NQTLs have been the topic of extensive MHPAEA implementing guidance issued by the federal administrative agencies—including proposed regulations issued in August 2023. Even so, NQTLs continue to present compliance challenges for employer-sponsored group health plans and health insurers. This Checklist includes information regarding NQTL comparative analyses (CAs), which are disclosure documents required under mental health parity legislation.
