MaintainedNew Jersey
A Checklist identifying considerations for counsel to a party submitting to a physical or mental examination under New Jersey Court Rule 4:19 (also called a defense medical examination (DME) or an independent medical examination (IME)). This Checklist discusses reviewing the examination notice, preparing the plaintiff for the DME, recording the DME or bringing a neutral third party to observe it, and moving for a protective order to bar an invasive DME. It also explains debriefing the plaintiff and any third-party observer, reviewing any recording, and what may occur if the plaintiff fails to submit to the DME.
