Internship Resources

  • Interns, Trainees, and Volunteers under the FLSA. A Practice Note discussing interns, trainees, and volunteers under the Fair Labor Standards Act (FLSA), including when interns and trainees must be classified as employees entitled to minimum wage and overtime pay and under what circumstances private sector employees may volunteer time and services. This Note is based on federal law and intended for private sector, for-profit employers.
  • Internship Program Checklist. A Checklist of Fair Labor Standards Act (FLSA) considerations for private sector, for-profit employers implementing or maintaining an internship program, including legal obligations, classification of unpaid interns as employees, and onboarding and termination protocols. This Checklist is based on federal law. State and local law may impose different or additional requirements.
  • Unpaid Internship Agreement (Learning Contract). An unpaid internship offer letter and agreement (also known as a learning contract). This letter agreement outlines the terms and conditions of a student's unpaid internship, including establishing the parties' expectations that the internship is unpaid with no promise of employment. This Standard Document is applicable to private, for-profit companies, is drafted in favor of the company, and is based on the Fair Labor Standards Act's (FLSA) unpaid internship requirements as interpreted by the Department of Labor (DOL) and federal courts. It has integrated notes with important explanations and drafting tips.
