Advocate General considers Belgian orders requiring filtering and blocking of infringing files contrary to EU law | Practical Law

Advocate General Cruz Villalón has given an opinion in which he recommends that the ECJ declare it to be contrary to EU law for the national court of a member state to make an order, on the basis of a particular Belgian statutory provision, requiring an ISP to install a system for an indefinite period and at their own expense to identify and block the transfer of files which allegedly infringe the copyright in music or films.
