CAT orders question of whether damages claim is time-barred to be heard as preliminary issue | Practical Law

On 20 May 2008, the Competition Appeal Tribunal (CAT) published an Order of the President in the damages action brought by BCL Old Co Limited against BASF (see Legal update, CAT publishes details of damages claim in relation to vitamins cartel). The Order sets out that the question of whether the action is time-barred under section 47A of the Competition Act 1998 and Rule 31 of the CAT's Rules should be heard as a preliminary issue. The Order also sets down a timetable for the filing of skeleton arguments and an agreed bundle of documents for the preliminary issue and lists a hearing for 7 July 2008.
