A Practice Note explaining the scope of civil liability under the False Claims Act (FCA). Specifically, this Note explains the commonly used FCA civil liability provisions, defines the elements that a plaintiff must plead and prove to prevail, and discusses the most common defenses. This Note also identifies the elements for a retaliation claim under the FCA.
