This Law Firm Publication by Jackson Lewis P.C. addresses the Healthy Delaware Families Act, signed into law on May 10, 2022. The new law allows employees in Delaware who have worked for their employer for one year (and at least 1,250 hours in that time) up to 12 weeks of leave and benefits for certain parental, family care-giving, and medical reasons. The new law provides benefits covering up to 80 percent of the employee's average weekly wage and job-protected leave. The related Family and Medical Leave Insurance Program will be funded by employer and employee contributions, which begin on January 1, 2025. Employees can begin using the job-protected paid leave on January 1, 2026.
