A Practice Note addressing final regulations issued by the Department of Health and Human Services (HHS) in April 2024 that amended the Privacy Rule under the Health Insurance Portability and Accountability Act of 1996 (HIPAA) to address reproductive health care. HHS's final regulations prohibit uses and disclosures of protected health information (PHI) for criminal, civil, or administrative investigations or proceedings against individuals, HIPAA covered entities (CEs), and CEs' business associates (BAs) for seeking, obtaining, providing, or facilitating reproductive health care that is lawful under the circumstances in which it is provided.
