This Practice Note provides an overview of the Freedom of Information Act (FOIA). Specifically, this Note summarizes the requirements imposed on federal agencies by FOIA when making both proactive disclosures and disclosures made in response to a request. This Note also summarizes the statutory exemptions and exclusions, as well as considerations for FOIA litigation.
