This practice note provides an overview of the initial issues that counsel should consider in planning the discovery of hard copy documents and electronically stored information (ESI). This note addresses creating a discovery plan, instituting a preservation protocol (including a litigation hold), consulting with opposing counsel, handling confidentiality issues, and preparing for the preliminary conference.
