Control

For the purposes of the Corporations Act 2001 (Cth) (CA 2001), an entity will control a second entity if it can determine the outcome of decisions about the second entity's financial and operating policies.
Whether one entity controls a second entity involves a consideration of the practical influence the entity can assert and any practice or pattern of behaviour affecting the second entity’s financial or operating policies (section 50AA,CA 2001).
In some cases control is given a specific meaning by the parties to an agreement to displace the statutory definition. The terms "controller" and "controlled" have similar meanings. (See Standard clause, Definitions and interpretation.)
