Paid family and domestic violence leave

For the purposes of Subdivision CA of Division 7 to Part 2-2 of the Fair Work Act 2009 (Cth) (FW Act), which forms part of the National Employment Standards (NES), paid family and domestic violence leave is a form of paid leave, which is available to national system employees who:
  • Need to do something to deal with the impact of family and domestic violence, where it is impractical to do so outside of ordinary hours of work.
Paid family and domestic violence leave is available from:
  • 1 February 2023 for employees of employers with 15 or more employees as at 1 February 2023.
  • 1 August 2023 for employees of employers with less than 15 employees (small business employers) as at 1 February 2023.
Reforms extending the entitlement to paid family and domestic violence leave under Part 6-3 to non-national system employees (and state referral employees in certain circumstances) commence on 9 June 2024, albeit noting there is a three-month delay on the application of those provisions.
