This Law Firm Publication by Epstein Becker Green discusses Washington State's new law rendering unenforceable non-compete agreements signed by employees who earn less than $100,000 annually and independent contractors who earn less than $250,000 annually. Non-competes of more than 18 months' duration also will be considered unreasonable and unenforceable under the new statute. The law, which was signed by Governor Inslee on May 8, 2019, becomes effective on January 1, 2020, and will apply to claims asserted thereafter even if the non-compete agreement was signed before the statute's effective date.
