A Practice Note explaining how to draft pretrial motion papers in a civil action pending in the New Jersey Superior Court, Law Division, Civil Part or a non-foreclosure action in the Chancery Division, General Equity Part. This Note identifies the documents counsel must prepare to file a motion, including the notice of motion, formal brief or letter brief, affidavits or certifications, the proposed order, and the proof of service (typically, a certification of service). It addresses the components of opposition papers, reply papers, and cross-motions. This Note also addresses the formatting and redaction requirements for motion papers, requesting oral argument, and seeking permission to file a sur-reply.
