This case study provides a worked example on how to commence and defend a straightforward commercial arbitration under the Hong Kong International Arbitration Centre (HKIAC) Administered Arbitration Rules 2008 (HKIAC Rules 2008). It provides examples of how to draft and file a Notice of Arbitration, how to respond to the Notice of Arbitration with an Answer to the Notice of Arbitration and, where appropriate, how to file a counterclaim.
