USPTO Issues Final Rule for Patent Term Adjustment Provisions of AIA Technical Corrections Act | Practical Law

The USPTO has issued a final rule adopting the interim rule it published on April 1, 2013 amending the rules of practice to implement the changes to the patent term adjustment provisions in Section 1(h) of the AIA Technical Corrections Act.

The USPTO has issued a final rule adopting the interim rule it published on April 1, 2013 amending the rules of practice to implement the changes to the patent term adjustment provisions in Section 1(h) of the AIA Technical Corrections Act.
On May 14, 2014, the USPTO announced it was adopting a final rule amending the rules of practice to implement the Patent Term Adjustment Provisions of the Leahy-Smith America Invents Act Technical Corrections Act (79 FR 27755).
The USPTO issued an interim final rule on April 1, 2013 detailing the rule revisions (for more information, see Legal Update, USPTO Issues Interim Final Rule for Patent Term Adjustment Provisions of AIA Technical Corrections Act).
This final rule adopts the interim final rule and also provides an optional procedure for requesting a recalculation of patent term adjustment, as an alternative to the petition and fee otherwise required to request reconsideration of a patent term adjustment determination, for patents issued between January 14, 2013 and May 20, 2014.
The final rule is effective May 15, 2014.
