This note discusses the principles, practice and procedure relevant to preparing, issuing, serving and responding to a bankruptcy notice on a debtor to recover a judgment debt or order owed to a creditor. It considers the formal and substantive requirements when preparing a bankruptcy notice, when and how a bankruptcy notice can be amended, and when and how an extension of time to serve a bankruptcy notice can be obtained. It also addresses a debtor's options to respond to a bankruptcy notice (in overview) and the consequences of taking no action.
