This note considers an employer's obligation to pay redundancy entitlements under the National Employment Standards (NES) in Part 2-2 of the Fair Work Act 2009 (Cth) (FW Act). It also considers the interaction between the NES minimum redundancy pay entitlement and an entitlement in a modern award or enterprise agreement.
