This Tracker provides an overview of state emergency orders and temporary legislation allowing remote online witnessing or notarization on an emergency basis that were put in place due to the 2019 novel coronavirus disease (COVID-19) (many of which have since expired or been overturned). Remote online notarization and witnessing, when available, is helpful for executing estate planning documents, such as wills, trusts, powers of attorney, and advance health care directives, in emergency situations or for clients with limited mobility during this public health crisis.
