Release of Liability and Waiver of Claims (Participant in Activity and Public Health Emergency) | Practical Law
A release of liability and waiver of claims (also referred to as a liability waiver) given by a customer or member of the general public to a service provider in connection with participation in an activity or use of a company's services. This liability waiver is intended to protect the company against liability for claims of illness, injury, or death resulting from the customer participating in a potentially dangerous or hazardous activity or being exposed to contagious or infectious diseases during an epidemic, pandemic (such as the 2019 novel coronavirus disease (COVID-19) pandemic), or other public health emergency. It contains a covenant not to sue and an acknowledgment of assumption of risk, as well as an optional indemnification.
