Format of Production

The technical manner in which an entity provides documents (including electronically stored information (ESI)) in response to a request for documents, subpoena, or Freedom of Information Act (FOIA) request.
Counsel may produce documents in hard copy or in an electronic format. Common electronic formats include:
Counsel should determine the required format of production as early as possible because some formats of production require counsel to preserve, collect, and process ESI in a specific manner.
Some courts have rules regarding format of production that:
  • Entitle requesting parties to specify the format in which the responding party produces documents.
  • Establish a default format of production that applies when the requesting party does not request a particular format.
