A Note providing an overview of issues that plan sponsors should be aware of when establishing an Internal Revenue Code (Code) Section 401(k) plan, including issues arising from operating and maintaining the plan. This Note also provides an overview of the Department of Labor (DOL) and Internal Revenue Service (IRS) correction programs available to plan sponsors, including the Employee Plans Compliance Resolution System (EPCRS), Voluntary Fiduciary Correction Program (VFCP), and Delinquent Filer Voluntary Compliance Program (DFVCP) should inadvertent errors in administration arise.
