Consumer guarantee

Statutory guarantees under the Australian Consumer Law (ACL) that apply minimum standards to the supply of goods and services to consumers.
In summary, goods must:
  • Be provided with full and unencumbered title and ownership.
  • Be of acceptable quality, match descriptions or samples and be fit for purpose.
  • Have spare parts available or be repairable.
  • Comply with any express warranties given.
Services must:
  • Be provided with due care and skill.
  • Be fit for purpose.
  • Be supplied at the agreed time or within a reasonable time.

Generally the guarantees, and liability arising from breach of them, cannot be excluded, modified or limited (section 64, ACL).
