The National Labor Relations Board (NLRB) is postponing the effective date of its rule requiring employers to inform employees of their rights under the National Labor Relations Act (NLRA) from January 31, 2012 to April 30, 2012.
On December 23, 2011, the NLRB postponed the effective date of the rule requiring employers to post a notice of employees' rights under the NLRA from January 31, 2012 to April 30, 2012. According to an NLRB press release, it is postponing the effective date to allow time for courts to resolve legal challenges to the NLRB's rule (see Legal Update, NLRB Postpones Deadline to Post NLRA Rights Poster). During oral argument in one of the pending litigations, US District Court for the DC Circuit, Judge Amy Berman Jackson requested that the NLRB postpone the effective date to permit substantive analysis of the legal issues.
This is the second time that the NLRB postponed the rule's effective date, which was originally November 14, 2011 (see Legal Update, NLRB Issues Final Rule Requiring Employers to Post Notices of NLRA Rights).
