While E-Verify participation is voluntary for most employers, it is mandatory for employers in certain states, and certain federal contractors and subcontractors. There is no cost to enroll or participate in the system.
The Immigration Reform and Control Act of 1986 requires employers to manually verify the identity and work authorization of all new employees using the I-9 form process. Employers enrolled in E-Verify take an additional step to check the employment authorization and social security number (SSN) of each new employee against DHS and SSA records. Participation gives the employer assurance of government confirmation of employment authorization.
