A Standard Document, for use by employers that do not offer their employees a health plan, to satisfy a notice requirement related to the health insurance exchanges under the Affordable Care Act (ACA). The ACA added Section 18B to the Fair Labor Standards Act (FLSA), which requires employers to provide written notice regarding the ACA health insurance exchanges to newly hired and current employees. A separate notice is available for employers that do offer a health plan to some or all employees. This Standard Document has integrated notes with important explanations and drafting tips.
