Consumer (ACL)
For the purposes of the
Australian Consumer Law
(
ACL
), a person (including a corporation) who acquires:
Goods
, where one or more of the following applies:
the amount paid or payable does not exceed $100,000 (prior to 1 July 2021, the threshold was $40,000);
the goods are of a kind ordinarily acquired for personal, domestic or household use or consumption; or
the goods consist of a vehicle or trailer acquired for use principally in the transport of goods on public roads.
Services
, where one or both of the following applies:
the amount paid or payable does not exceed $100,000; or
the services are of a kind ordinarily acquired for personal, domestic or household use or consumption.
For the purposes of the
ACL
, a person (including a corporation) is not a consumer, if goods are acquired:
For re-supply (but if the goods are gift cards, only if the re-supply is
in trade or commerce

To be used, in trade or commerce, as a part of a production or manufacturing process or to repair goods or fixtures on land.
