In Sebastian Holdings Inc v Deutsche Bank AG [2010] EWCA Civ 998, the Court of Appeal considered the construction of jurisdiction clauses in a series of related agreements entered into over a period of time and an appeal from a decision refusing to stay the English proceedings in favour of proceedings in New York.
NB: Permission to appeal this decision to the Supreme Court was refused on 15 February 2011.
