We have published Article, West Tankers: the never-ending story, authored by Kieron O'Callaghan, Julianne Hughes-Jennett and Alice Wallace-Wright of Hogan Lovells International LLP. The West Tankers saga has spawned a litany of proceedings, from arbitration in London, proceedings before the Court of Justice of the European Union (ECJ) and culminating (to date) in the decision of Flaux J in the English Commercial Court on 4 April 2012, which itself is on appeal. This article considers the various proceedings in the saga, the practical implications of the decisions and includes a useful flowchart showing the story to date.
