We have published an article which examines the impact of two recent decisions, White Industries and Bharat Aluminium, on investment arbitration in India.
We have published Article, India faces heat from foreign investors following White Industries award, authored by Indian Advocate, Neha Bajpaee. The article examines the White Industries Australia Ltd v Republic of India (UNCITRAL) (Final Award) and Bharat Aluminium Co v Kaiser Aluminium Technical Services Inc (Civil Appeal No 7019 of 2005) decisions and their impact on investment arbitration in India. The White Industries ruling opened the floodgates to investment arbitration for foreign companies aggrieved by conduct of the Indian state, while the Bharat Aluminium judgment restricts the interference of the local courts in arbitrations that are seated outside India.
