On 24 March 2008, the Antitrust Division of the US Department of Justice (DOJ) announced it was closing its investigation of XM Satellite Radio Holdings Inc.'s proposed merger with Sirius Satellite Radio Inc. In finding that the proposed combination of satellite radio providers is not likely to substantially lessen competition, the DOJ relied on the following factors: the lack of competition between the parties in certain segments; the alternative sources for audio entertainment currently available to consumers; the anticipated development of new or improved alternatives to satellite radio; and the efficiencies likely to flow from the proposed transaction that could benefit consumers.
