Disclosure Review Document (DRD)

The document by which parties identify, discuss and seek to agree the scope of any search-based Extended Disclosure (Models C, D or E) sought, under Practice Direction (PD) 57AD ("Disclosure in the Business and Property Courts"). PD 57AD took effect on 1 October 2022, bringing the procedures that applied under the Disclosure Pilot Scheme (PD 51U), from 1 January 2019 until 1 October 2022, into force on a permanent basis.
The DRD replaces the disclosure report and Electronic Documents Questionnaire, which apply for cases subject to the disclosure regime under Civil Procedure Rule 31, PD 31A and PD 31B.
Since 1 November 2021, there have been two versions of the DRD. For "mainstream" PD 57AD cases, the DRD and accompanying guidance is now at Appendix 2 to PD 57AD. For claims subject to the simplified procedure for Less Complex Claims (introduced on 1 November 2021), there is a simplified DRD and guidance (Appendices 6 and 7 to PD 57AD).
Key provisions on completion of the Disclosure Review Document are set out in PD 57AD.10.1 to 10.9.
The claimant will usually take the lead in completing the DRD, but, in an appropriate case, where the claimant is acting in person and the defendant is not, the court may require the legal representatives of the defendant to lead on the preparation and filing of the DRD (PD 57AD.10.9).
