Will for Individual with Spouse or Partner: Pot Trust for Children (TX) | Practical Law

A will for spouses or unmarried couples who have children and reside in Texas. If the testator is survived by a spouse or partner, this will provides for an outright distribution of the testator's estate to the surviving spouse or partner. If the testator is not survived by a spouse or partner, this will provides for a distribution of the estate to the testator's surviving children or more remote descendants in a testamentary trust. It creates a pot trust (also called a pooled trust) for descendants until the youngest child reaches a certain age and then divides the assets into separate shares for outright distribution to or into further separate share trusts for each child. This Standard Document has integrated notes with important explanations and drafting tips.
