Antitrust Division

The division of the Department of Justice (DOJ) that focuses on antitrust enforcement. It is headed by an Assistant Attorney General. The Antitrust Division has exclusive jurisdiction over criminal antitrust enforcement of Section 1 and Section 2 of the Sherman Act. It shares jurisdiction for civil enforcement of the Sherman Act and Clayton Act with the Federal Trade Commission (FTC), state attorneys general, and private parties (see Practice Notes, DOJ and FTC Antitrust Investigations and Criminal Antitrust Enforcement in the US).
The Antitrust Division also assists foreign authorities in determining whether a person has violated or is about to violate a foreign antitrust law under the International Antitrust Enforcement Assistance Act of 1994 (see Practice Note, US Antitrust Laws Overview: International Antitrust Enforcement).
