A Practice Note explaining a special motion to strike in Superior Court under California Code of Civil Procedure Sections 425.16 to 425.18, known as California's anti-strategic lawsuit against public participation law (anti-SLAPP). This Note explains the scope of the anti-SLAPP law, discusses strategic reasons for raising it, and explains procedural issues unique to an anti-SLAPP motion to strike, including when to file the motion, the parties' burdens of proof, costs and attorneys' fees available to the moving and nonmoving parties, appealing an anti-SLAPP motion ruling, and SLAPP-back actions in response to SLAPP lawsuits.
