A note considering the effect of Part 1 of and Schedule 3 to the Economic Crime (Transparency and Enforcement) Act 2022 (ECTEA 2022) on land ownership and transactions in England and Wales. The ECTEA 2022 includes provisions which are designed to compel overseas entities to register in the register of overseas entities (ROE) in certain circumstances, where the overseas entity already owns, or wishes to acquire or make certain dispositions of, a qualifying estate (a freehold or a leasehold granted for a term of more than seven years from the date of grant).
