Insolvency Regulation: main and secondary proceedings | Practical Law

The European Court of Justice has held that, where both main and secondary insolvency proceedings are opened under the EU Regulation on insolvency proceedings (1346/2000/EC), the courts in both proceedings have jurisdiction to determine which assets fall within the scope of the secondary proceedings.
