A Practice Note addressing Department of Labor (DOL) requirements for association health plans (AHPs) under regulations finalized in June 2018. The 2018 AHP final regulations, which became the subject of litigation in 2018, were intended to expand the ability of small employers and sole proprietors to join in a group or association of employers to provide health coverage. Key provisions of the final regulations were vacated by court order in March 2019. In December 2023, the DOL proposed to rescind the 2018 AHP final regulations in their entirety.
