This Practice Note provides an overview of Division I proposals under the Bankruptcy and Insolvency Act, R.S.C. 1985, c. B-3 (BIA). Proposal proceedings are a form of debtor-in-possession restructuring, allowing the debtor to continue to operate and staying enforcement action against the debtor while the proposal is formulated and voted on.
